The classical social anarchists developed a critique of modern society, including a rejection of the penal system and the social, political and economic role of the law, lawyers and courts generally, that distinguished them from conservatives, liberals and Marxists. Contemporary anarchists, particularly Michel Foucault and Giorgio Agamben, have framed their critique in somewhat different terms, developing a theory of biopower and rejecting the value of the doctrine of human rights. This lecture will discuss and elaborate these views sympathetically in an effort to show that anarchists share many of the insights into the role of law in society revealed by empirical research. An anarchist view challenges the claimed virtues of modern society without being reactionary, nor should it be considered utopian. It raises questions about both law and society that belong on the agenda of current scholarship.
